DISPUTE RESOLUTION NOTICE
UNLESS YOU OPT OUT WITHIN 30 DAYS, DISPUTES WILL BE RESOLVED BY INDIVIDUAL ARBITRATION, WITH A CLASS ACTION WAIVER AND JURY TRIAL WAIVER, AS EXPLAINED BELOW.

1. Scope
These Terms govern your access to forhumanity.co, our apps, and related services, including telehealth intake, care coordination, pharmacy fulfillment, devices, non-prescription products, and auto-renew subscriptions (the “Service”). Our Privacy Policy describes how we handle personal information:

2. Relationship of Parties (We are not your provider or pharmacy)
- ForHumanity Health, Inc. (“ForHumanity”, “we”, “us”) is not a medical group or pharmacy.
- Independent medical groups and licensed clinicians deliver care and make all prescribing decisions.
- Independent pharmacies (503A/503B) compound/dispense and ship medications.
- We provide the platform, support, devices, non-Rx products, and billing. We do not practice medicine or control clinical judgment.
- Medical groups, providers, and pharmacies are third-party beneficiaries of Sections 2, 4–7, 10, 13–18, and 22.
3. Eligibility & Territory
- You must be 18+, located in the United States, and able to form a contract.
- We only ship where partner pharmacies hold required licenses.
- We do not knowingly collect information from children under 13.
4. Telehealth & Informed Consent
- Telehealth may use video, audio, or secure messaging (as allowed by state law).
- Providers must be licensed where you are located at the time of the consult.
- You’ll review and accept a Telehealth Consent before receiving care and may withdraw consent any time before services are rendered.
- Providers may decline or refer you to in-person care if telehealth is not appropriate.
5. Prescription Pathway & Pharmacy Choice
- A prescription is required for certain products. A prescription is never guaranteed.
- If a prescription is issued, you may direct it to a pharmacy of your choice. Some compounded products may only be available through certain licensed pharmacies.
- We use standard e-prescribing formats consistent with NCPDP SCRIPT requirements.
6. Compounding Disclosures (503A / 503B)
- Some items may be compounded and therefore not FDA-approved; FDA has not evaluated them for safety or effectiveness.
- 503A: patient-specific compounding based on an individual prescription.
- 503B: outsourcing facilities compound under cGMP; products remain not FDA-approved.
- Labeling and instructions may differ from FDA-approved products. Your provider will determine appropriateness.
7. Cash-Pay / No Medicare or Medicaid Billing
Unless we clearly state otherwise, services are cash-pay and are not billed to Medicare, Medicaid, or other government programs. HSA/FSA use is plan-dependent. You are responsible for all charges.
8. Subscriptions & Recurring Billing (Transparency)
Snapshot:
- Total price & cadence: shown at checkout and in your account.
- Renews: auto-renews every 30 or 90 days (plan-dependent) until you cancel.
- Early charge: we may charge up to 5 days early to keep shipments on time.

- Effective date of cancellation: end of the current billing cycle. No pro-rata refunds unless required by law.
- Commitment plans (if selected): you agree to a set number of quarterly payments; an early-termination charge equal to discounts already received may apply (never more than the discount you took).
- Price changes: we’ll email at least 30 days’ notice before the next charge.
- Renewal reminders: we send reminders where required by law (e.g., annual reminders in certain states).
Your consent. You must affirmatively agree to recurring charges at checkout. We send a confirmation email with the material terms and easy cancellation methods.
9. Shipping; Title & Risk of Loss
We ship via common carriers. Title and risk of loss pass at delivery scan. Report loss or damage within 10 days of expected delivery; we’ll investigate and reship when appropriate. Some items may require special handling.
10. Returns, Refunds & Replacements (Summary)
- Prescription & compounded medications: Final sale once dispensed. Due to safety and law, pharmacies generally cannot accept returns. Exceptions: wrong item, damaged, or carrier loss → we will reship or issue a credit.
- Devices (DPI hardware): 30-day return if unopened/unused; manufacturer defects covered under our limited warranty (repair/replace).
- Non-Rx (e.g., supplements): 30-day unopened returns; opened returns only for a documented adverse reaction (subject to clinical review).
- Consult fees: non-refundable once services are rendered. For full instructions (RMAs, what to include), see our Refund & Return Policy, which is incorporated by reference.
11. Your Account; Security; E-SIGN
Create an account to use many features. Keep your login secure and your info current. You agree to receive and sign records electronically (E-SIGN/UETA). We may place holds or close accounts for fraud, non-payment, or misuse.
12. Acceptable Use
Don’t misuse the Service. Examples include: attempting to obtain drugs by fraud; sending malware; scraping; reverse engineering; interfering with security; violating law; or harassing others. We may suspend or terminate for violations.
13. Privacy; HIPAA & State Privacy
14. Intellectual Property & License
We own the Site, software, text, images, and marks. We grant you a limited, personal, revocable license to use the Service for lawful, non-commercial purposes. No scraping, framing, or derivative works without our written consent.
15. Your Submissions & Feedback
Outside of Protected Health Information, content you send us (e.g., feedback, suggestions) may be used by us to run and improve the Service. We don’t claim ownership of your PHI and handle PHI per Section 13.
16. Third-Party Goods & Services
Medical groups, providers, pharmacies, labs, shippers, and payment processors are independent third parties. We aren’t responsible for their acts or omissions. Any third-party terms also apply.
17. Payment; Taxes; Billing Issues
You authorize charges to your selected payment method for orders, renewals, taxes, shipping, and fees. If a payment fails, we may retry and place shipments on hold. You’re responsible for any required taxes where we don’t collect.
18. Warranty Disclaimers
Except as stated in a device warranty, the Service and products are provided “AS IS.” We do not guarantee medical outcomes, that a prescription will be issued, or uninterrupted access. Compounded drugs are not FDA-approved.
19. Limitation of Liability
To the fullest extent allowed by law, our total liability for any claim related to the Service will not exceed the total amounts you paid to ForHumanity in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages.
20. Indemnity
You agree to defend and hold harmless ForHumanity and its affiliates from claims arising out of your misuse of the Service, breach of these Terms, or violation of law.
21. Termination
We may suspend or terminate accounts for violation of these Terms, fraud, non-payment, or legal risk. You may stop using the Service at any time. Sections that by their nature should survive (including 13–19 and 22–29) will survive termination.
22. Arbitration; Class Action Waiver; 30-Day Opt-Out
- Agreement to arbitrate. Any dispute with us (or with our partner medical groups or pharmacies) related to the Service will be resolved by individual arbitration with NAM (National Arbitration and Mediation) under NAM Comprehensive Dispute Resolution Rules, seated in San Diego County, CA.
- No class actions. No class, collective, or representative actions or arbitrations.
- Small-claims exception. Either party may bring an individual claim in any U.S. small-claims court with jurisdiction.
- Costs & fees. The forum’s consumer rules apply. Each side pays its own attorneys’ fees unless applicable law requires otherwise.
- 30-day opt-out. You may opt out by emailing legal@forhumanity.co or mailing a signed notice within 30 days of first accepting these Terms. Opting out keeps all other Terms in place.
23. Governing Law & Venue
These Terms are governed by Delaware law (without its conflicts rules). For any non-arbitrable matters, venue lies in the courts of Delaware.
24. DMCA (Copyright) Notices
If you believe content on our Site infringes your copyright, email support@forhumanity.co or mail:

with a notice containing all elements required by 17 U.S.C. §512(c)(3). We may remove content and notify the user. We accept counter-notices as permitted by law.

27. Changes to the Service and These Terms
We may update the Service and these Terms prospectively. We will post the effective date and, for material changes, notify you by email or in your account.
28. Assignment; No Agency
You may not assign your rights here. We may assign to an affiliate or in connection with a merger or sale. These Terms do not create a partnership, joint venture, or agency.
29. Severability; Waiver; Entire Agreement; Contact
If any part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce isn’t a waiver. These Terms (plus policies linked here) are the entire agreement regarding the Service.

Addendum A — Device Limited Warranty (Summary)
For ForHumanity-branded devices, we warrant against defects in materials and workmanship for 1 year from delivery. We will repair or replace, at our option. This warranty does not cover misuse, accidents, or unauthorized modifications. This is your exclusive device warranty.
